Acceptable Use Policy

How you may and may not use KwaFlux, including content restrictions, copyright and DRM rules, cloud processing restrictions, and enforcement.

This Acceptable Use Policy (“AUP”) explains how you may and may not use KwaFlux. It forms part of the Terms of Service and applies to the website, desktop application, cloud processing features, remote rendering, AI cloud features, accounts, credits, output results, support channels, and related services.

1. You must have rights to your content

You may use KwaFlux only with media you own, created, licensed, or are otherwise legally authorized to process.

You may not use KwaFlux to upload, process, enhance, remove marks from, modify, export, publish, or commercialize third-party media unless you have the legal right to do so.

You are responsible for obtaining all rights, permissions, consents, releases, and legal authority required for your input files, prompts, processing instructions, and output results.

2. Copyright, watermark, and DRM restrictions

You may not use KwaFlux to:

  • Remove or obscure copyright watermarks, platform marks, ownership notices, rights-management information, attribution, or source identifiers from content you do not own or are not authorized to edit.
  • Circumvent DRM, technical protection measures, subscription walls, platform controls, paywalls, access restrictions, or licensing systems.
  • Republish, resell, monetize, or redistribute third-party copyrighted media without authorization.
  • Mislead others about ownership, source, authorship, license status, or AI enhancement.
  • Facilitate infringement of copyright, trademark, publicity, privacy, contractual, or proprietary rights.

3. Personal rights and privacy restrictions

You may not use KwaFlux to:

  • Invade privacy.
  • Process private or sensitive media without consent or lawful authority.
  • Reconstruct, expose, enhance, identify, or make searchable a person, location, face, body, license plate, private space, or sensitive personal information in a way that violates law or rights.
  • Create, enhance, or distribute non-consensual intimate imagery.
  • Target, harass, intimidate, stalk, dox, exploit, blackmail, or shame any person.
  • Process media involving children unless you have all rights, consents, and legal authority required by law.

4. Deepfake and deception restrictions

You may not use KwaFlux to create, enhance, or distribute synthetic or altered media intended to:

  • Deceive people into believing false events occurred.
  • Impersonate someone without consent.
  • Commit fraud or scams.
  • Defame, harass, or manipulate others.
  • Create fake evidence.
  • Mislead voters, customers, audiences, employers, platforms, payment processors, advertisers, law enforcement, courts, or public authorities.

You are responsible for making disclosures where required by law, platform policy, advertising rules, or context.

5. Illegal and harmful content restrictions

You may not use KwaFlux for:

  • Child sexual abuse material or sexualized minors.
  • Non-consensual sexual content.
  • Human exploitation or abuse.
  • Terrorist or extremist abuse.
  • Fraud, identity theft, phishing, scams, blackmail, extortion, or illegal surveillance.
  • Malware, credential theft, cyber abuse, or security compromise.
  • Hate, harassment, threats, or unlawful discrimination.
  • Content that violates applicable law.

6. Cloud processing restrictions

You may not upload to cloud processing or remote rendering any content that violates this AUP, the Terms of Service, applicable law, third-party rights, or platform rules.

We may use automated and manual safeguards to detect abuse, protect infrastructure, enforce usage limits, investigate security incidents, respond to legal obligations, and protect users or third parties.

We may refuse, stop, delete, or block cloud tasks that we reasonably believe violate this AUP or create legal, safety, security, or infrastructure risk.

7. Service abuse restrictions

You may not:

  • Share, sell, rent, transfer, or resell accounts.
  • Circumvent licensing, entitlement, billing, session, device, export, credit, queue, storage, or cloud processing controls.
  • Use automation, bots, scripts, scraping, credential sharing, abnormal traffic, or abusive patterns to overload or exploit the Service.
  • Extract outputs at scale to build datasets or train competing models.
  • Use KwaFlux as a hosted service, API, managed service, service bureau, white-label service, or third-party commercial processing tool unless we expressly authorize it in writing.

8. AI model and competitive-use restrictions

Unless we expressly agree in writing, you may not use KwaFlux, its outputs, models, documentation, benchmark results, evaluation results, workflows, or cloud systems to:

  • Train, fine-tune, validate, benchmark, improve, or support a competing AI model, machine learning system, video enhancement service, image enhancement service, or media processing product.
  • Create datasets for model training, benchmarking, or evaluation.
  • Reverse engineer or infer model architecture, model weights, prompts, pipelines, or non-public system design.

9. Reporting abuse

If you believe KwaFlux is being used to infringe your rights, violate privacy, distribute non-consensual content, or engage in unlawful activity, contact legal@kwaflux.com.

Please include enough information for us to review the issue, such as links, screenshots, account details, task identifiers, ownership evidence, authorization status, and a description of the alleged violation.

10. Enforcement

If we reasonably believe you have violated this AUP, we may:

  • Suspend or terminate your account.
  • Disable licenses, credits, cloud tasks, downloads, outputs, storage access, or support.
  • Delete or block cloud files or tasks.
  • Refuse or revoke refunds where allowed by law.
  • Investigate abuse, preserve records, and cooperate with lawful requests.
  • Report unlawful conduct to appropriate authorities.

We may update this AUP from time to time. Continued use of the Service after changes become effective means you accept the updated policy.
